Terms of Use

• You must be at least 18 years old, or the age of majority where you live, to create an account.
• Give accurate information, keep your password secure, and tell us right away at support@gigtools.net if you think your account has been used without permission.
• You're responsible for what happens under your account and for the people you invite to your organization and the roles you give them.
• An organization's owner controls the organization and its data, including who has access.

You own the information, files, photos, videos, text and other material you put into GigTools (“Your Content”). You give us a limited permission to host, store, copy, display and send Your Content only as needed to run the Service for you, including showing it on public pages you choose to publish and sending the messages you ask us to send.

You confirm that you have the rights and permissions needed for Your Content, including:

• permission to store and contact the people in your contacts, and consent from anyone you text or add to marketing emails;
• rights to the photos, videos, logos and other material you upload or publish, and permission from acts before publishing their profiles;
• that reviews and testimonials you publish are genuine and approved by the people who gave them.

Don't use GigTools to:

• send spam, or email or text people who haven't agreed to hear from you where the law requires consent;
• break any law, including anti-spam (CAN-SPAM, TCPA), privacy and consumer protection laws;
• publish anything false, misleading, defamatory, infringing, hateful or harmful, or fake reviews;
• collect sensitive information you don't need, such as full Social Security or bank account numbers, outside the places GigTools provides for it;
• try to access other organizations' data, get around security or limits, or disrupt the Service;
• copy, resell or reverse-engineer the Service, or use bots to scrape it.

We may remove content or suspend access that breaks these rules.

Some features (such as the organization website) are available only on paid plans like GigTools Pro. Prices and what each plan includes are shown when you sign up or upgrade.

• Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel.
• You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep paid features until then.
• Except where required by law, fees already paid are non-refundable, including for partial periods.
• We'll give you at least 30 days' notice before a price change affects your subscription.
• Prices don't include taxes, which may be added where required. Payments are handled by our payment processor.
• If a payment fails, we may limit paid features until it's resolved. Your data stays available on the free plan.

GigTools works with services run by others, such as Google (Gmail and Calendar), email and text-message providers, and the video and social sites you link to. Your use of those services is governed by their own terms. We're not responsible for them, and a connection may stop working if a provider changes or ends its service.

GigTools helps you manage bookings, send agreements for electronic signature, and track payments, but we're not a party to any agreement between you and your clients, acts, venues or others, and we don't handle money between them. You're responsible for the content of your agreements, for checking they suit your needs and the law where you work, and for your own taxes and tax forms. GigTools doesn't give legal, tax or financial advice.

The assistant gives answers generated by AI from the help center and your account information. Answers can be wrong or incomplete, so check anything important before relying on it.

The Service, including its software, design, text and the GigTools name and logo, belongs to Jenisan, Inc. and is protected by law. These Terms don't give you any rights to it beyond using the Service. If you send us feedback or ideas, we may use them without any obligation to you.

You can stop using GigTools and ask us to close your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if your use puts others or the Service at risk. Where reasonable, we'll tell you first and give you a chance to fix the problem.

After an account is closed, you can ask for a copy of your data within 30 days. After that, we delete it as described in the Privacy Policy. Sections 2, 4 (for amounts owed), 6, 8 and 10 to 14 continue to apply after these Terms end.

We work hard to keep GigTools reliable, but the Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, that messages or calendar updates will always be delivered, or that reminders will always be sent on time. Keep your own copies of anything critical.

To the fullest extent the law allows, GigTools and its officers, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, bookings, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100. Some places don't allow these limits, so they may not fully apply to you.

You'll defend and hold harmless GigTools from claims, losses and costs (including reasonable legal fees) arising from Your Content, your messages to others, your agreements with other people, or your breach of these Terms or the law.

These Terms are governed by the laws of the State of Arizona and applicable US federal law, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be brought only in the state or federal courts located in Maricopa County, Arizona, and you and we consent to their jurisdiction. Either party may bring an eligible claim in small claims court instead.

To the fullest extent the law allows, claims may be brought only on an individual basis, not as a plaintiff or class member in a class, collective or representative action.

• Changes: we may update these Terms. For significant changes, we'll notify account holders by email or in the app at least 30 days before they take effect. Continuing to use GigTools after that means you accept the new Terms.
• Whole agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• Severability: if any part is found unenforceable, the rest stays in effect.
• No waiver: not enforcing a term right away doesn't mean we give it up.
• Assignment: you can't transfer these Terms without our consent; we may transfer them as part of a merger, sale or reorganization.
• Events beyond control: neither of us is responsible for delays caused by things outside reasonable control, such as outages of providers we rely on.
